Worker Agreement

This Worker Agreement ("Agreement") applies specifically to you if you register on WorkQuora as a freelance worker ("worker", "you"). It supplements — and does not replace — our Terms & Conditions, which also apply to you. In the event of a conflict on a worker-specific matter, this Agreement controls.
1. Independent contractor status — no employment relationship
You are an independent, self-employed contractor, not an employee, agent, partner, or representative of WorkQuora. Nothing in this Agreement, the Platform, or your use of it creates an employer-employee relationship, a partnership, or a joint venture between you and WorkQuora.
Specifically, and without limitation:
- You are not entitled to any employment benefits from WorkQuora — no provident fund, ESI, gratuity, paid leave, minimum wage protection, or any other benefit under Indian labour law that applies to an employer-employee relationship.
- You set your own availability, choose which jobs to propose on, and determine how to perform the work you accept, subject only to the specifications the client describes in the job posting.
- You may work for other platforms or clients outside WorkQuora; WorkQuora does not require or expect exclusivity.
- WorkQuora does not supervise, direct, or control the manner in which you perform accepted work — only the client-worker relationship for that specific job governs that.
Your contractual relationship for each job is directly with the client who accepted your proposal. WorkQuora is not a party to that service contract; WorkQuora provides the platform, escrow payment handling, and dispute-support infrastructure through which that contract is formed and paid.
2. Tax responsibility
You are solely responsible for your own tax obligations, including income tax on your earnings from jobs completed through the Platform, and any GST registration or liability that may apply to your services under applicable law based on your turnover. WorkQuora does not withhold income tax on your behalf and does not file returns for you. WorkQuora's own commission and the GST WorkQuora charges on that commission (Section 4 below) are WorkQuora's tax obligations on its own fee, separate from and not a substitute for your personal tax compliance. You should consult a tax professional regarding your obligations, particularly once your Platform earnings reach a level that triggers GST registration requirements under Indian law.
3. Identity verification (KYC) is mandatory
You must complete WorkQuora's identity verification process — PAN, Aadhaar, a selfie for identity matching, and bank account details for payout — before you can accept jobs or withdraw funds. This is described in full in our Privacy Policy. WorkQuora reserves the right to reject or request resubmission of KYC documents that appear incomplete, altered, or fraudulent, and to suspend your ability to accept jobs until verification is complete.
4. Commission and payment
WorkQuora deducts a platform commission of 10% of the gross job value, plus 18% GST on that commission amount, from the payment released to you when a job is marked complete. For example, on a job valued at ₹1,000: the platform fee is ₹100, GST on that fee is ₹18, and you receive a net payout of ₹882. Payouts are credited to your in-app wallet on job completion and can be withdrawn to your verified bank account, subject to the withdrawal process in the app. WorkQuora is not responsible for delays caused by your bank or by incomplete/incorrect bank details on file.
5. Chat and communication rules
You may not initiate contact with a client about a job before either the client has messaged you first or has accepted your proposal — this rule exists to prevent unsolicited solicitation and is enforced by the Platform. Once a job is completed or cancelled, the chat becomes read-only; you retain access to the message history for a limited period as described in our Privacy Policy, but cannot send new messages in that thread.
6. Cancellations and repeated cancellations
Cancelling a job you have accepted affects your payout and, if it becomes a pattern, your standing on the Platform — see our Cancellation Policy for the exact schedule. WorkQuora's policy is that repeated cancellations may result in a penalty up to and including account suspension. As disclosed transparently in our Compliance Report, this specific penalty mechanism is a stated policy that WorkQuora is in the process of implementing operationally; until automated enforcement is in place, WorkQuora reserves the right to apply this policy manually on a case-by-case basis, including account suspension, where a pattern of cancellations is identified.
7. Ratings and reputation
Clients rate you after each completed job. Your rating, completion rate, and other reputation signals may affect your visibility in job matching and your standing on the Platform. You agree that ratings reflect the client's genuine assessment and that WorkQuora may display your rating history to prospective clients.
8. Suspension
WorkQuora may suspend or deactivate your account for: submission of fraudulent KYC documents; repeated job cancellations; harassment, fraud, or other conduct violating our Community Guidelines; attempting to circumvent Platform payment (soliciting a client to pay you outside the app for a job sourced through WorkQuora); or other material breach of this Agreement or the Terms & Conditions. Where practicable, we will notify you of the reason and provide an opportunity to respond through our grievance process before permanent suspension.
9. Insurance and liability for your work
You are solely responsible for the quality, safety, and legality of the services you perform, and for carrying any insurance, license, or permit your trade requires under applicable law. WorkQuora does not inspect, certify, or guarantee your skills or the outcome of any job — see our Disclaimer.
10. Location and tracking during a job
While a job is in progress, the app may transmit your live location to the client so they can see your approach, as described in our Privacy Policy. This location data is relayed in real time and is not stored by WorkQuora after the fact.
11. Termination
You may stop using the Platform at any time and request account deletion as described in our Privacy Policy. This Agreement's tax-responsibility and confidentiality obligations survive termination of your account.
12. Acknowledgement
By registering as a worker on WorkQuora, you acknowledge that you have read and agree to this Agreement, the Terms & Conditions, the Privacy Policy, the Cancellation and Refund Policies, and the Community Guidelines, each of which is incorporated by reference.
